These terms govern access to and use of the Adker marketing and operations management platform (the “Platform”). By creating an account, connecting an integration, or using the Platform, you accept these terms and our Privacy policy.
1. The service
The Platform lets you connect third-party services, review data about campaigns, stores, and operations, generate reports, and run the available actions that the user requests. The specific features may depend on the plan purchased, the permissions assigned, and the availability of each external provider.
2. Account and authorization
- You must provide accurate information and keep your access credentials secure.
- You are responsible for the actions taken from your account and for assigning appropriate permissions to the members of your business.
- You may only connect accounts, business portfolios, stores, and assets that belong to you or for which you have sufficient authorization.
- You must notify us if you detect unauthorized access or misuse of your account.
3. Integrations and third-party data
When you connect Meta, Shopify, Dropi, or another provider, you authorize us to access, store, and process the information needed to provide the service and carry out your instructions. Use of each integration is also subject to the terms and policies of the corresponding provider.
On Meta we request four permissions and no more: ads_management to read metrics and manage campaigns, ad sets, and ads; business_management to discover the business portfolios and ad accounts you manage; and pages_show_list together with pages_read_engagement to read the ID, the name, and the follower count of the Facebook Pages you manage, because every ad is delivered on behalf of a Page. We do not read posts, comments, or messages, we do not see who your followers are, and we never publish content on a Page. The integration also does not create or delete campaigns.
You can withdraw this authorization at any time from your Facebook account settings, under Settings → Apps and websites. When you do, we delete the connection and everything we had obtained with it, on the terms of the Privacy policy.
For Meta-based features, you agree to comply with the Meta Terms of Service and the Meta Platform Terms.
4. Actions on campaigns and assets
The Platform only attempts to make changes to campaigns, ad sets, ads, accounts, or stores when an authorized user requests them or when an automation has been set up in advance by your business. Those changes may include pausing or activating items and adjusting budgets or bid caps and cost caps. You are responsible for reviewing the setup, the permissions, the budgets, and the outcome of those actions.
5. Permitted use
You may not use the Platform to:
- Break the law, infringe third-party rights, or violate the policies of the connected providers.
- Access data, accounts, or systems without authorization.
- Introduce malicious software, interfere with security, or attempt to bypass access controls.
- Resell, copy, decompile, or exploit the Platform beyond what the law or a written agreement allows.
- Use the service to send misleading, fraudulent, discriminatory, or illegal content.
6. Your data and content
You keep whatever rights you have over the data and content you add or connect. You grant us a limited authorization to host, process, transmit, and display it only to the extent needed to provide, protect, and improve the service. The processing of personal data is described in the Privacy policy.
7. Intellectual property
The Platform, its software, design, trademarks, documentation, and components belong to their respective owners and are protected by applicable law. These terms grant you a limited, revocable, non-exclusive, and non-transferable right to use the service while your account is active.
8. Plans, payments, and service changes
When a feature requires a paid plan, the price, billing cycle, taxes, and terms stated before purchase will apply. We may update or replace features to maintain security, meet third-party requirements, or improve the service. If a material change affects your rights, we will communicate it by a reasonable means.
9. Availability and external services
We work to keep the Platform available and secure, but we do not guarantee that it will run without interruptions or errors. The availability and accuracy of data coming from Meta, Shopify, Dropi, and other third parties depend on their APIs, permissions, limits, and systems. We do not control those external services.
10. Decisions and outcomes
The reports, alerts, recommendations, and content generated by the Platform are support tools. You must review the information before making commercial, financial, advertising, or logistics decisions. We do not guarantee specific results in sales, profitability, or advertising performance.
11. Suspension and termination
You can stop using the Platform and disconnect your integrations at any time. We may restrict or suspend access when there is a breach of these terms, a security risk, fraud, non-payment, or a legal or external-provider requirement. When reasonably possible, we will explain the cause and the options available.
12. Liability
To the extent permitted by law, we will not be liable for indirect losses, lost profits, or damages caused solely by third-party services, settings made by the user, or uses contrary to these terms. None of the above limits any non-waivable rights recognized by applicable law.
13. Governing law
These terms are governed by the laws of the Republic of Colombia. Any dispute will be handled before the competent authorities, without prejudice to the rights that consumer protection rules grant the user.
14. Changes to these terms
We may update these terms. The version in force will be published at this same address with its update date. Continued use of the Platform after the changes take effect implies acceptance, unless the law requires a different form of acceptance.
